Terms and Conditions for Owner

A. Services Fees

  1. We charge a service fee payable by owner of a property on the Site via the Site checkout. The service fee covers the use of the Site, and is calculated as a variable percentage of the total reservation amount.
  2. The service fee will only be refunded in the event a traveler is entitled to a refund of the entire rental amount under the terms of the cancellation policy presented in the listing
  3. We provide Reservation Services to manage inquiries, quotes, and rental agreements and to allow for payments to be made relating to the rental.
  4. Please review the following terms and the terms and conditions carefully. If you do not agree to these or such third-party provider’s terms, you have no right to obtain information from or otherwise continue using our Reservation Services. Failure to use our Reservation Services in accordance with the following terms of use may subject to penalties and or closing your account without compensation of any kind .
  5. No member may request any traveler to mail cash, or utilize any instant-cash wire transfer service such as Western Union or MoneyGram in payment for all or part of a property rental transaction. Any violation of this term or any other unacceptable payment methods that may be posted on the Site may result in the immediate removal of the non-conforming listing from the Site without notice to the member and without refund. From time to time, we may become aware of users attempting to conduct a transaction that would involve an unauthorized payment method or a fraudulent payment method. Ideally, we hope to be able to assist users in avoiding such transactions, but we assume no liability or responsibility to do so or to inform users of any such actual or suspected activity.
  6. For all pay-per-booking listings, the terms and conditions in effect at the time a booking is accepted will govern and supersede any prior agreement between us and you with respect to your use of the Site.

B. Responsibility for Property and Traveler Liability.

  1. Users are solely responsible for obtaining insurance coverage sufficient to protect their properties and guests or their trip, as applicable. Members agree that they have or will obtain the appropriate insurance coverage sufficient to cover the rental of the properties they list on the Site before the arrival of their first traveler and will maintain adequate insurance coverage through the departure date of any traveler they have obtained via our Site. Further, members agree to provide us with copies of relevant proof of coverage upon request.

A. lISTING A PROPERTY

  1. All property listings on the Site are the sole responsibility of the member (who may be the owner or a property manager or duly authorized agent of the owner) and we specifically disclaim any and all liability arising from the alleged accuracy of the listings, reviews or any alleged breaches of contract on a user’s part. Members are solely responsible for keeping their property information up-to-date on the Site, including, but not limited to, any and all representations about any property, its amenities, location, price and its availability for a specific date or range of dates. We do not represent or warrant that any of the copy, content, traveler or property reviews, guest book entries, property location, suitability, pricing or availability information published on the Site is accurate or up-to-date even in the case where travelers have searched for specific dates or types of properties. 
  2.  Each listing must relate to an individual and uniquely identified property.
  3. We also may from time to time create new descriptions or otherwise change the location or geographic descriptions we use to identify properties in their listings and search results. Consequently, we may change the location or geographic description associated with any property listing at any time without notice. However, we assume no responsibility to verify property listing content or the accuracy of the location. Members are solely responsible for ensuring the accuracy of location, geographic and other content and location or geographic descriptions and agree to promptly correct (or contact us to correct) any inaccuracy and travelers are solely responsible for verifying the accuracy of such content and descriptions.
  4. We cannot guarantee that your listing will appear in any specific order in search results on the Site. Search order will fluctuate based on a variety of factors such as search parameters, subscription level purchased, listing quality, how frequently a calendar is updated, traveler preferences, member response time, reservation history, online booking capability, compliance with posted listing practice requirements, and other factors that we may deem important to the user experience from time to time (“Best Match”). Listing appearance or order in any particular search result may also vary depending on the search criteria used by the particular traveler.
  5. Photographs should depict the vacation rental as the main subject of the photograph and may not include children or adults if you do not have their legal consent or any information or images that would violate the privacy rights, intellectual property rights (including but not limited to copyright rights) or any other rights of a third party. We reserve the right to not display or to remove any photographs that we determine, in our sole discretion, do not meet these Terms or are otherwise unacceptable to us.
  6. We reserve the right to refuse hypertext links to, or addresses of, other web sites from members’ pages, and to remove links or web addresses without notice at our sole discretion. Further, we reserve the right to charge for hypertext links at any time.
  7. The property in a listing may not be substituted for another property without our consent. We may approve a request in our discretion if the property manager’s contract for the property was terminated and the member provides sufficient proof, as requested by us, and completes any additional forms we may request
  8. The listing cannot be a mere example of properties in a given area. Only one property can appear on each listing, unless it is a property with multiple rental units and additional listings are purchased. We reserve the right to amend the copy or remove any listing when more than one property is described in such listing.
  9. If, in our sole discretion, any member submits unsuitable material to our Site or into our database, is not abiding by local rental regulations and is creating a nuisance in its community, misuses the Site or our online system or is in material breach of these Terms, we reserve the right to limit the member’s use of the Site, impact the member’s listing(s) search position, and/or terminate such member’s listing immediately without refund. In addition, if we become aware of or receive a complaint or a series of complaints from any user or other third party regarding a member’s listing or rental practices that, in our sole discretion, warrants the immediate removal of such member’s listing from the Site (for example, and without limitation, if a member double-books a property for multiple travelers on the same date, or engages in any practice that, in our sole discretion, would be considered deceptive, unfair or improper within the vacation rental industry or in an online marketplace for vacation rentals, if we determine or suspect that the member’s payment-related practices or procedures are not secure, legal or otherwise proper, or if we receive a complaint that any listing’s content infringes on the rights of a third party), then we may immediately terminate such member’s listing(s) or subscription(s) without notice to the member and without refund. We assume no duty to investigate complaints. Finally, if any member is abusive or offensive to any employee or representative of the HomeAway Group, we reserve the right to terminate such member’s listing(s) or subscription(s) immediately without refund.
  10. The Property Owner reserves the right to alter furniture, internal fittings or amenities in the apartment without prior notice. Although we make every effort to update the pictures advertised, we cannot take responsibility for minor differences between the illustration, text or photograph and the actual property. If substantial changes are made to essential parts of the apartment, we will inform you as soon as possible

Terms and conditions for Guest

A. PAYMENT POLICY

  1. The rental price, including taxes, is payable in advance, by means of a credit card transaction.
  2. In the event of damage to the rented property or when the tenant returns the rented residence to a state that requires abnormal housekeeping, abnormal cleaning or any other abnormal maintenance, riviera-maya.net may withhold an estimate of the market value of the goods or the cost of services under the guarantee, without prejudice to its other rights. In the event of a breakage, an amount equivalent to the value of the breakage or damage will be deducted and/or retained from the security deposit, if necessary.
  3. In the event of late departure, the tenant agrees to the revision of the rental price in accordance with the pricing in force (accessible online: riviera-maya.net). riviera-maya.net may then automatically retain the price difference from the guarantee, without prejudice to its other rights.
  4. The rental prices advertised on the riviera-maya.net website (https://www.riviera-maya.net/) are subject to change without notice.
  5. The number of occupants displayed on the contract must be respected at all times, both inside and outside the property. If the number of occupants is not respected, an immediate eviction of the group on site without reimbursement and/or additional costs will apply, without prejudice to its other rights.
  6. Users’ bank or credit card companies may impose certain fees or charges, including, but not limited to, foreign transaction fees, related to any rental of a property. It is the user’s obligation to review any agreement with its bank or credit card company concerning any such fees.

B. RESERVATION MODIFICATION POLICY

  1. The tenant can request a modification of his rental dates, according to the following conditions:
    1. Your request must be made more than 30 days before the date of your stay
    2. Depending on the availability of the residence on the desired dates.
    3. With the agreement of the owner of the property initially rented.
  2. The price of the new stay will be equivalent to or higher than the stay initially paid for according to the period selected. (example: If you rent in the summer and transfer the dates to a busier period, the rate may be higher for an equivalent number of nights).
  3. In the case of a modification of the dates of the stay for a more expensive stay, we will not be able to honor the price initially paid, it will be the duty of the tenant to pay the difference between the old stay and the new stay.
    1. The tenant must submit to payment of the difference in the rental price if applicable. No refund will be granted to the tenant if he changes his dates for a rental at a lower price.
    2. If the desired dates are not available, the tenant can decide:
      1. a) to keep its original rental dates.
      2. to cancel his reservation according to the cancellation conditions provided for in the contract.
  4. No modification can take place less than 30 days before the scheduled rental date.
  5. The properties offered by Riviera-Maya.net are privately owned residential properties and not official tourist accommodation such as hotels, bed & breakfasts, pensions or hostels. As such, they cannot be rated or categorised according to conventional international standards. Indeed, the individual architecture and furnishings of each property reflects the local culture and traditions as well as the Property Owner’s personal taste. It is precisely this type of accommodation that Riviera-Maya.net specializes in offering, so that you can enjoy an authentic experience of living like a local and appreciating the unique Riviera-Maya way of life in comfort.

C. CANCELLATION POLICY

  1. In the event of cancellation of the reservation in whole or in part, the tenant must diligently inform riviera-maya.net by e-mail.
  2. A cancellation made within 24 hours of confirmation of the reservation can be canceled free of charge.
  3. A cancellation made more than 60 days before the date of arrival at the property will result in the loss of an amount of 10% of the total amount of the reservation as damages.
  4. A cancellation made more than 30 days before the date of arrival at the property will result in the loss of the reservation deposit (30% of the total amount of the reservation) as damages.
  5. A cancellation made less than 30 days before the date of arrival at the property will result in the loss of all sums received so far (100% of the total amount of the reservation).

C. OCCUPANCY POLICY

  1. During the night, the residence cannot be occupied by more people than the maximum authorized capacity (accessible online: riviera-maya.net/ the listing page of the property). The tenant must notify riviera-maya.net by email of any change to this effect. If this number is not respected, riviera-maya.net reserves the right to charge a minimum penalty of $100usd.
  2. In the situation where the stay should be canceled or interrupted due to unforeseen problems in the building (water, electricity, etc.), the landlord’s liability would be limited to the rental cost. Unused days would then be refunded, but no additional compensation would be granted.
  3. Smoking is prohibited in the building. Please use the appropriate spaces outside and dispose of cigarette butts in the places intended for this purpose.
  4. ANIMALS are not allowed unless otherwise specified when booking.
  5. The tenant must put into practice all the instructions related to the use of the residence communicated by the landlord or made available directly on site.

D. RESPONSIBILITIES

  1. The tenant declares to rent the property exclusively for vacation purposes.
  2. The tenant respects the privacy of the residence. He uses the rented goods with prudence and diligence. Upon arrival, the tenant inspects them carefully and immediately informs riviera-maya.net of the poor condition of a property (a description of the property is available online: riviera-maya.net/ the listing page of the property) He informs riviera-maya.net of any defect or deterioration of property during the stay. On his departure, he is required to return the property to the condition in which he received it.
  3. The tenant declares to be aware that the property could be is located in a natural environment, in the heart of a complex of residences for recreational and tourist purposes. Under penalty of immediate expulsion and without reimbursement, he ensures that anyone on the premises acts in accordance with the law and adopts responsible and prudent conduct at all times. It prevents anyone on the premises from disturbing the peace or causing abnormal inconvenience to the neighbourhood. In particular, it guarantees the absolute tranquility of the neighborhood during the night, from 11 p.m., under penalty of immediate expulsion and without reimbursement.
  4. The tenant guarantees compliance, inside the residence, with the ban on anyone smoking and the ban on bringing or tolerating an animal, failing which he assumes the cost of housekeeping, cleaning or any other maintenance necessary for the complete and final elimination of the smell, hair or fleas, without prejudice to the other rights of the owner.
  5. The tenant guarantees compliance with the ban on anyone, outside the rented property, throwing a cigar or cigarette butt anywhere other than in an ashtray and that of leaving any rubbish elsewhere than in a garbage can.
  6. The tenant is liable for material and bodily damage occurring in or on the rented residence during the rental period, for any reason whatsoever, except for damage not caused by it or its occupants and those resulting defects in construction, lack of maintenance, natural and technological disasters, and any damage normally covered by the owner’s home insurance policy. The tenant and any other person on the rented premises undertake to hold the owner and his agent, riviera-maya.net, free and harmless from any claim presented by anyone resulting from the damage for which they are responsible. The tenant is responsible for damage caused by his personal acts and those of the persons accompanying him and he will be given an invoice for any damage caused to the property (except normal wear and tear of the premises).
  7. Prior to arrival, are left free of charge for the exclusive use of the occupants of the residence, during their stay; bedding (blankets, sheets, pillows and pillowcases), toilet paper and basic household cleaning products. The owner is not required, however, to leave for their use towels, personal hygiene products. The decision to leave these amenities available free of charge is up to the owner.
  8. Lessee may not sublet or otherwise assign its rights in this Agreement.
  9. The parties, if it is necessary to seize a court of a dispute between them, elect domicile in the judicial district of the principal residence of the owner of the property.
  10. In the unlikely event that you should encounter any technical problems or you are unsatisfied with the cleanliness of the apartment upon arrival, please contact us immediately to ensure that necessary arrangements may be made as soon as possible. Any complaints must be addressed to The owner and Riviera-Maya.net in writing by email at the beginning of your stay. 
  11. Neither we nor the property owner can be held responsible for breakdown of mechanical equipment such as pumps or boilers etc, nor for failure of public utilities such as water or electricity. In the unlikely event of breakdown of mechanical equipment such as pumps or boilers etc., you are required to contact the Owner to ensure that necessary arrangements are made as soon as possible.

LIMITATION OF LIABILITY

  1. The owner, his representative, Riviera-Maya.net, or their agents assume no responsibility for any material damage related to the rental or occurring during it, except in the event of intentional or gross negligence. In addition, the tenant guarantees the owner, his representative, Riviera-Maya.net, and their agents, the prudent and diligent use of the rented goods. It also guarantees them that, at all times, anyone on the premises — inside and outside the property — acts in accordance with the law and adopts prudent and diligent conduct. Consequently, the tenant agrees to the owner, his agent, Riviera-Maya.net, or their agents, to indemnify in the event of a lawsuit and to exempt them from the payment of all disbursements and fees – judicial and extra judicial – and, where applicable, all damages and related compensation.
  2. Neither the owner, nor his agent, Riviera-Maya.net, or their agents can be held responsible for the theft or loss of the property of the tenant or his guests during the stay.
  3. The owner, his representative, Riviera-Maya.net, or their agents cannot be held responsible for any accident, injury or illness resulting from the fault of the tenant, which may occur to the tenant or his guests during the stay. By accepting this reservation, the renter and his guests accept the risks associated with their stay at the establishment.
  4. The person requesting a residence reservation agrees to enter into this rental contract using the features of the Riviera-Maya.net website. (https://www.riviera-maya.net) when, after having clicked on the button used to accept the conditions of the contract online, she completes the online form provided for this purpose.
  5. The tenant declares to be of legal age and not to be subject to any protective regime limiting his legal capacity to bind himself by contract.
  6. Riviera-Maya.net, for the purposes of this rental contract, acts as an agent, exclusively in the name and on behalf of the owner, and does not bind itself personally towards the tenant.
  7. Users are granted a limited, revocable non-exclusive license to access the Site and the content and services provided on the Site solely for the purpose of advertising a property, searching for a property, purchasing or researching (for the purpose of inquiring about purchasing) any of the products or services offered on any Site, participating in an interactive area hosted on the Site or for any other purpose clearly stated on a Site, all in accordance with the Terms. Any use of the Site that is not for one of these purposes or otherwise in accordance with the Terms or as otherwise authorized by us in writing is expressly prohibited.
  8. User verification on the Internet is difficult and we cannot, and do not assume any responsibility for, the confirmation of each user’s purported identity. We encourage you to communicate directly with a traveler or member through the tools available on the Site, though even this does not assure you of the identity of the person with which you are communicating. We further encourage you to take other reasonable measures to assure yourself of the other person’s identity and, for travelers, of the property and relevant details of your booking or proposed booking.
  9. We discourage you from giving anyone access to your online ID and password for your account with us and your email account. However, if you do give someone your online ID and online password, or if you fail to adequately safeguard such information, you are responsible for any and all transactions that the person performs while using your account with us and/or your email account, even those transactions that are fraudulent or that you did not intend or want performed.  
  10. We have no duty to pre-screen content posted on the Site by members, travelers or other users, whether directly contributed by the user or contributed by us or a third party on behalf of the user (including, without limitation, property listings, reviews of a rental property or a traveler, participation in an interactive community, forum or blog (each an “Interactive Forum”) or any other content provided by a user to the Site), (collectively, “user-contributed content”). We are not responsible for user-contributed content. “User-contributed content” also includes information that a user or any other person provided to a third party website or mobile application that is then provided to our Site by a tool we offer or any other exchange of user-contributed content we have authorized.
  11. We may change, suspend or discontinue any aspect of the Site at any time, including the availability of any Site features, database or content. We may also impose limits on certain features or services or restrict your access to parts or the entire Site without notice or liability. 
  12.  Subscription rates and fees (including any commissions) charged for any listing that is not subscription based (such as pay-per-booking) are set at the time of a user or member’s purchase of the subscription or renewal or sign up for the non-subscription-based listing, as applicable. Such rates and fees are subject to change without notice or approval. For subscription listings, the rates in effect at the time of the member’s next subscription renewal, new listing or a member’s upgrade or any other additional or new order of any product or service will govern for such renewal or other order.
  13. Neither Riviera-Maya.net (acting as agent for the Property Owner) nor the Property Owner shall be responsible for personal injury of any person residing in or visiting the apartment, unless this results from the proven negligence of ourselves.
